iCloud Communications to sue Apple over iCloud

Apple could be in the middle of a new trademark dispute. Last week Arizona-based iCloud Communications has filed suit against the Cupertino based computing giant.


The Next Web, has published a copy of the suit which states: ‘The goods of services with which Apple intends to use the ‘iCloud’ mark are identical or closely related to the goods and services that have been offered by iCloud Communications under the iCloud Marks since its formation in 2005.’

It continues: ‘Apple’s announcement of and the launch of its advertising campaign for its iCloud service have so thoroughly swamped the reputation of iCloud Commuications….. that it is likely to cause – and has actually caused – confusion among consumers.’

Formed in 1985 according to its website iCloud Communications is a telephone provider, integrating voice and data applications.

This isn’t the first time Apple has found itself in a dispute over trademarks. Remember Apple Computer Vs the Beatles Apple Corps? That was initially settled with Apple promising never to enter the music business, but following the launch of the iTunes Music Store, Apple Corps sued again. It was only last year that Beatles music finally appeared on iTunes.

It will be interesting to see what happens in this latest dispute, the suit states: Monetary relief alone is inadequate to fully address the irreparable injury.’ Will this mean Apple has to change the name? We’ll have to wait and see.
