The shock news that Apple’s recent injunction will see the Samsung Galaxy Tab 10.1 pulled from the shelves of shops across Europe was an even bigger surprise for Samsung themselves, who have claimed they had no idea it was going to happen.
Speaking to CNET, a spokesperson from Samsung said: “The request for injunction was filed with no notice to Samsung, and the order was issued without any hearing or presentation of evidence from Samsung.”
Apple took out the injunction in a court in Germany, although the action is binding throughout the EU. The only EU country where the Galaxy Tab 10.1 is safe for the moment is the Netherlands, where Apple must pursue the case separately to get the tablet banned.
Apple, meanwhile, have come out in defence of the injunction, saying the Galaxy Tab 10.1 is a “blatant” rip-off of the iPad. “It’s no coincidence that Samsung’s latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging” said a spokesperson from Apple. “This kind of blatant copying is wrong, and we need to protect Apple’s intellectual property when companies steal our ideas.”
Samsung will have an opportunity to appeal the decision in German court, but must now wait for a court date. In the meantime, Sammy’s Android tablet will have to wait in the wings.
