YouView loses High Court appeal in brand dispute with YOUR VIEW

YouView has lost a High Court appeal against Total Ltd, a business-to-business provider which operates an online billing portal called YOUR VIEW.

When YouView initially applied to the Trade Marks Registry in May 2012, it was ruled that its name was ‘confusingly similar’ to YOUR VIEW.

This is despite YouView being a digital TV service firmly in the consumer market and YOUR VIEW but one facet of a company operating in the B2B sphere.

While this news appears to cast doubt on the future of YouView’s ability to call itself thus in the market, a spokesperson told us that “YouView has no intention of changing its name. This matter is complex and subject to a number of on-going legal actions and will be settled in the courts.”

Total Ltd’s managing director Stuart Baikie, said “We are delighted with the judgment. YourView is a key differentiator for us and is a significant part of our business and future growth strategy, so it was absolutely imperative that we defended the trade mark that was granted to us in 2009.”

While there’s no arguing that Total Ltd have the rights to the YOUR VIEW name, we find it hard to believe that anyone would seriously confuse the two products, which have about as much in common as chalk and cheese.
