An injunction preventing the sale of the Samsung Galaxy Tab 10.1 has been partially lifted, so the Android Honeycomb tablet will soon be available in European countries with the exception of the Germany.
It’s not back on sale for good though – the Dusseldorf regional court has temporarily lifted the injunction preventing the tablet been sold through the European Union, until the court hearing on August 25th.
This follows news today that the evidence used by Apple against Samsung may be flawed. However the reason for the injunction being lifted are based around the legality of a German court banning a company with its HQ in South Korea, from selling a product outside of Germany.
This means the Samsung Galaxy Tab 10.1 should now be available in every country, with the exception of Germany. Samsung started selling the tablet again in Holland yesterday. Apple is pursuing a separate court action in Holland.
The ban was initially enforced last week – a few days after the Galaxy Tab 10.1 launched in the UK, at the time Samsung admitted it wasn’t pre-warned of the decision. Over the last few weeks it’s been a constant round of injunctions, ensuring it’s certainly been a busy time for both company’s legal departments.
Patent issues aside, it’s certainly good news for the consumer that the Tab 10.1 will be available soon. You can read our full Samsung Galaxy Tab 10.1 review here, but after testing it we think it is best Honeycomb tablet to date.
The Apple Vs Samsung court date is still planned for August 25th, so we’ll have to wait until then to see what the final outcome will be.
