Apple wins Samsung Galaxy Tab 10.1 ban in Germany

The twisting turning Apple Vs Samsung battle continues. Apple has won this round as Samsung now can’t sell its Galaxy Tab 10.1 Honeycomb tablet in Germany.


The district court in Dusseldorf has just ruled that the Samsung Galaxy Tab 10.1 can’t be sold in Germany, because of its similarities with the Apple iPad 2, although the ruling doesn’t apply to other countries – including the UK.

According to Computer World, Samsung has said it will appeal against the hearing: ‘We are disappointed with this ruling and believe it severely limits consumer choice in Germany….. We will take all available legal options including continuing to aggressively pursue Apple for its ongoing violation of Samsung’s wireless technology patents around the world.”

 

The courtroom battle has been raging for a while now. The Samsung Galaxy Tab 10.1 barely hit shelves of shops in the UK when it was dramatically pulled – initially from the whole of Europe including the UK (with the exception of Holland).

Later it appeared the Dusseldorf court’s jurisdiction didn’t apply to Europe and the Tab was back on sale as the injunction lifted.

Samsung appealed, amid rumours the evidence Apple presented was flawed and that the images could have been distorted.

Just this week in a separate injunction Samsung had to remove the Galaxy Tab 7.7 from its stand at the IFA consumer electronics show in Berlin.

We’ll have to wait and see what happens now – we can’t wait to try out the Tab 7.7 and try out the Super AMOLED screen, we’ll bring you more news as soon as we get it.
